These Terms of Use ("Terms") govern your access to and use of the services provided by Aleph Lab, Inc., a Delaware corporation ("Aleph Lab", "we", "our", or "us"). By creating an account, purchasing a subscription, or allowing your child to use our services, you ("you" or "Parent/Guardian") agree to be bound by these Terms. If you do not agree, do not use our services.
1.1 Parent/Guardian Responsibility. Our services are designed for children in grades 1 through 9. Accounts must be created by a parent or legal guardian for children under the age of majority in their jurisdiction.
1.2 Parental Consent. For children under 13 in the United States (and other applicable jurisdictions), verifiable parental consent is required in compliance with the Children’s Online Privacy Protection Act (COPPA).
1.3 Child Accounts. Children may use the services only under parental supervision. At Aleph Lab’s discretion, older children (e.g., 13+) may be permitted to manage their own accounts, subject to parental authorization.
2.1 Nature of Services. Aleph Lab provides AI-powered language learning companions accessible through third-party platforms such as Minecraft and Roblox.
2.2 Educational Disclaimer. The services are designed as a supplemental language-learning tool. They are not a certified educational program and should not be relied upon as a substitute for formal schooling, tutoring, or curriculum.
2.3 Third-Party Platforms. Aleph Lab is not affiliated with Mojang/Microsoft, Roblox, or any other platform providers. Parents and guardians remain responsible for ensuring their child’s safe use of those platforms.
3.1 Free Trials. We may offer a free trial (e.g., 7 days). At the end of the trial, unless canceled, your subscription will automatically convert to a paid subscription.
3.2 Subscription Billing. Subscriptions are offered on a monthly or annual auto-renewing basis. By subscribing, you authorize us (through our payment processors, such as Stripe and LemonSqueezy) to charge your payment method on a recurring basis until canceled.
3.3 Refund Policy. Except as required by law, all charges are non-refundable. However, Aleph Lab may, at its sole discretion, grant refunds or credits on a case-by-case basis (e.g., in cases of accidental double billing or technical defects).

5.1 User-Generated Content. The services may capture user interactions, including voice, text, and gameplay data ("User Content").
5.2 License to Aleph Lab. You grant Aleph Lab a non-exclusive, worldwide, royalty-free license to use anonymized User Content solely for:

6.1 Parental Responsibility. Parents/guardians are responsible for monitoring their child’s use of the services.
6.2 Third-Party Risks. Aleph Lab is not liable for interactions, risks, or harms occurring within third-party platforms (e.g., Minecraft/Roblox).
7.1 Aleph Lab IP. All AI companions, software, designs, curriculum, and related technology are the exclusive property of Aleph Lab.
7.2 No Affiliation. Aleph Lab is not affiliated with, endorsed by, or sponsored by Mojang/Microsoft, Roblox, or any third-party platform.
7.3 Restrictions. You may not copy, modify, reverse engineer, or create derivative works from Aleph Lab’s services or content.
7.4 Open Source Software. The services may incorporate open-source components. In particular, they include software licensed under the MIT License:

8.1 Your Rights. You may cancel your subscription at any time through your account settings. Cancellation prevents future billing but does not entitle you to a refund for prior charges (except where granted at our discretion).
8.2 Our Rights. Aleph Lab may suspend or terminate your access at any time for violations of these Terms, harmful conduct, or legal reasons.
9.1 Disclaimer. Services are provided “as is” and “as available.” Aleph Lab makes no guarantees of specific educational outcomes or error-free operation.
9.2 Limitation of Liability. To the maximum extent permitted by law, Aleph Lab’s total liability to you is limited to the amount you paid us in the 12 months preceding the claim.
9.3 Exclusions. Aleph Lab is not liable for indirect, incidental, or consequential damages, including loss of learning outcomes, data, or profits.
10.1 Arbitration Agreement. Any dispute arising under these Terms will be resolved by binding arbitration in Delaware, administered by the American Arbitration Association (AAA), under its Commercial Arbitration Rules.
10.2 Waiver of Class Actions. You may only resolve disputes with Aleph Lab individually, not as part of a class or representative action.
10.3 Opt-Out. You may opt out of arbitration within 30 days of creating your account by emailing hannim@alephlab.ai.
10.4 Governing Law. These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
We may update these Terms at any time. Updates will be posted on our website, and material changes will be notified by email to subscribers. Continued use of the services after changes take effect constitutes acceptance of the updated Terms.
